Terms & Conditions

The general conditions applying to mastering and related audio services provided by Noztiluna.

1. General

These Terms & Conditions apply to all mastering and related audio services provided by Noztiluna di Alessandro Boschi, Verbania, Italy. By requesting a service, the client agrees to these Terms & Conditions. The scope of the project, price and estimated delivery time are agreed with the client before work begins.

2. The mastering service

Each project is personally evaluated before work begins. The service may include stereo mastering, stem mastering, mix repair or other audio services agreed in advance. The mastering process is based on the audio material supplied by the client. Noztiluna is not responsible for technical or musical problems already present in the supplied material. Additional work outside the agreed scope may be quoted separately.

3. Preview, revisions and approval

A preview of the mastered material is provided before final delivery. Up to three reasonable revision rounds are included where applicable. Once the client approves the final preview, the mastering is considered approved and the project is ready for payment and final delivery.

4. Payment and final delivery

Payment is due after approval of the final preview and before delivery of the complete final master. Preview files are provided exclusively for evaluation and approval and may not be publicly released, distributed or commercially exploited. Final master files are delivered after full payment has been received.

5. Right of withdrawal

Where applicable, consumers have a statutory 14-day right of withdrawal for distance contracts. The client may expressly request that the mastering service begins before the withdrawal period has expired. If the client withdraws after the service has begun but before it has been fully performed, the client may be required to pay a proportionate amount corresponding to the service already provided.

The right of withdrawal does not apply after the service has been fully performed where the client expressly requested that the service begin before the withdrawal period expired and acknowledged that the right of withdrawal would be lost once the service was fully performed. Noztiluna will obtain this request and acknowledgement before beginning the service.

6. Cancellation and refunds

The mastering service includes a preview and, where applicable, up to three revision rounds before final approval. Once the final preview has been approved by the client and payment has been made, the project is considered completed and no refunds are provided for change of mind, artistic preference or dissatisfaction with the approved result. Technical errors attributable to Noztiluna will be corrected or the affected files will be replaced at no additional cost. This does not affect any mandatory statutory rights.

7. Client files, backups and responsibilities

The client confirms that they have the necessary rights and permissions to provide the audio material to Noztiluna for processing. Noztiluna keeps backup copies of project files for its own records and, where reasonably possible, to facilitate future re-delivery or updates. Backup storage is provided as a courtesy and does not constitute a guarantee of permanent or loss-proof storage. Noztiluna cannot be held responsible for accidental loss or corruption caused by events beyond its reasonable control, including hardware failure, deterioration of storage media, natural disasters or other unforeseen events. Clients are advised to keep their own backup copies of all submitted and delivered files.

8. Turnaround and rush service

Estimated delivery times are agreed individually for each project. Delivery times may vary depending on the complexity of the work, revisions, additional requests or circumstances outside Noztiluna’s reasonable control. Rush delivery is available only when specifically agreed in advance.

9. Intellectual property

All copyrights and related rights in the client’s music and recordings remain with the client or the respective rights holders. Noztiluna does not acquire ownership of the client’s music or recordings through the mastering service.

10. Liability

Noztiluna will perform the agreed services with reasonable professional care. Noztiluna is not responsible for problems caused by defective, incomplete or technically unsuitable source material supplied by the client. Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is not permitted by applicable law.

11. Credits

Where applicable, the client agrees to credit the mastering engineer as follows:

“Mastered by Alessandro Boschi at Noztiluna Mastering”

This credit should be used wherever mastering credits are normally provided, including digital metadata, streaming platforms, liner notes, digital booklets and other release information.

12. Privacy

Personal data is processed in accordance with the Noztiluna Privacy Policy. Project files are used solely for providing the requested services and are not made publicly available.

13. Applicable law

These Terms & Conditions are governed by Italian law. Where the client is a consumer residing in another EU country, mandatory consumer protection provisions applicable in the client’s country of residence remain unaffected.
